Terms of Service
1. Acceptance of Terms
By creating an account on Motivated Land Leads ("the Service"), operated by Land Buyers Alliance LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Motivated Land Leads is a marketplace that provides pre-screened, enriched motivated seller land leads to registered buyers ("Members"). Leads include seller contact information, property details, enrichment data, and AI-generated summaries. Each lead is sold once to a single buyer.
3. Eligibility
You must be at least 18 years of age and legally capable of entering into a binding contract to use the Service. By registering, you represent that you meet these requirements.
4. Account Registration
You agree to provide accurate, current, and complete information during registration and to update such information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must self-identify your buyer type (Investor, Wholesaler, or Agent) honestly. Misrepresentation of your buyer type may result in account suspension.
5. Token System
The Service operates on a prepaid token system. Tokens are the exclusive purchasing currency for lead purchases on the platform.
1 token = $1.00 in purchasing power. Token balances are displayed in your account dashboard at all times.
Token purchases: Tokens are sold in packages with a minimum purchase of 100 tokens ($100). Larger packages include bonus tokens at no additional cost. All token purchases are processed securely via Stripe.
Non-refundable: All token purchases are final. Tokens cannot be refunded and cannot be converted to cash under any circumstances. This policy applies to all token purchases regardless of whether the tokens have been used.
No expiration: Tokens never expire. They remain in your account until used, regardless of account inactivity.
Account closure: In the event of account closure or termination, unused tokens are forfeited and will not be refunded or transferred.
Promo codes: From time to time, promotional codes may be offered that add bonus tokens to a purchase. Promo codes have no cash value, are non-transferable, may not be combined with other offers, and are subject to expiration and usage limits as specified at the time of issuance.
6. Lead Purchases
All lead purchases are final. When you purchase a lead using tokens, you receive access to the seller's contact information and associated enrichment data. Leads are sold on an as-is basis. The Company does not guarantee any particular outcome from contacting a seller.
Lead prices are denominated in tokens and are subject to change. The token price displayed at the time of purchase is the price you pay. Token balances are automatically applied at checkout.
7. Token Protection Policy
Tokens may be returned to your balance in the following circumstances, based on the percentage of the token price paid for the affected lead:
- Wrong or disconnected contact information: 100% of tokens returned
- Significant misrepresentation of property or seller situation: 100% of tokens returned
- Undisclosed title issues: 50% of tokens returned
- Undisclosed wetlands: 50% of tokens returned
- Unreasonable seller: 25% of tokens returned
- No agreement reached: 10% of tokens returned
Token refund requests must be submitted through your account dashboard under My Tokens. All requests are reviewed within 2 business days. Refunds are issued exclusively as tokens to your account balance — never as cash. Tokens returned through this policy never expire. The Company reserves the right to deny requests that appear fraudulent, are submitted an unreasonable time after purchase, or do not meet the criteria above.
8. Tier System
The Service operates a tiered access system. Tier 1 (Investor) members receive a 72-hour exclusive window on new leads. After 72 hours, leads become available to Tier 2 (Wholesaler) members. Tier 3 (Agent) members access returned leads. Tier windows and pricing are subject to change with reasonable notice.
9. AI-Generated Content Disclaimer
AI-generated content provided with leads — including motivation scores, property briefs, and summaries — is provided for informational purposes only. It does not constitute legal, financial, or investment advice. The Company makes no warranties regarding the accuracy or completeness of AI-generated content. You are solely responsible for conducting your own due diligence.
10. Prohibited Conduct
You agree not to:
- Share, resell, or redistribute lead data to third parties
- Use lead data for any purpose other than making a direct offer to the seller
- Attempt to circumvent the tiered access system
- Submit fraudulent token refund requests
- Harass, spam, or contact sellers in an abusive manner
- Use automated tools to scrape or download marketplace data
11. Intellectual Property
All content on the Service, excluding seller-submitted data, is owned by Land Buyers Alliance LLC. You may not copy, reproduce, or distribute any part of the Service without prior written permission.
12. Limitation of Liability
To the maximum extent permitted by law, Land Buyers Alliance LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service or any leads purchased through the Service. Our total liability for any claim shall not exceed the amount you paid for the lead giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless Land Buyers Alliance LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your interactions with sellers.
14. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may close your account at any time by contacting us. Unused tokens are forfeited upon account closure and will not be refunded or transferred.
15. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Sarasota County, Florida.
16. Changes to Terms
We may update these Terms from time to time. We will notify registered members of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
